1. What you authorize
ⓘ Each time you confirm a payment from your bank, you allow us to take that amount from your bank account.
By linking a US bank account and confirming a payment funded from it, you authorize us and our money transmission partner for that payment — Bivo Inc. (NMLS 2572288) or Cybrid, Inc. (NMLS 2796311), depending on how the payment is processed — to initiate ACH debit entries to that account — and, if a debit is made in error, a credit entry to correct it — for the amount and on the date shown when you confirm. This includes:
- Adding money to your Cash Plus Account.
- Funding transfers to India paid directly from your bank.
- Pay with Xpat purchases from merchants paid from your bank.
- Scheduled and repeating payments you set up, for each amount and date shown, until you cancel them.
- Any fees shown to you before you confirm the payment.
- Recovery debits for any Amount Owed — for example because a debit was returned, a payment was charged back or reversed, or your balance went negative — as described in “Automatic recovery of amounts you owe”. We will tell you the amount and the date of a recovery debit at least 10 days before we make it.
Each confirmation in the app or on the website is your electronic signature on that authorization. For repeating payments, your authorization covers every payment in the series on the schedule you chose. If the amount of a repeating payment changes, we will tell you before the debit, as the law requires.
We use Plaid to connect your bank account. When you link an account, you allow Plaid to give us your account and routing numbers, the account holder’s name and balance information so that we can verify the account and reduce returned payments. Our Privacy Policy explains how we handle this information.
2. Your promises to us
ⓘ You confirm the bank account is yours to use and that there will be enough money in it.
Each time you authorize a debit, you confirm that:
- you are an owner or authorized signer on the bank account and have the right to authorize debits from it;
- the account is a US consumer or business account held in your name (or, for a business profile, in the business’s name), and is not someone else’s account;
- you will have enough available funds in the account on the date of each debit;
- you will not ask your bank to return a debit you authorized.
You must keep your linked bank details up to date and remove an account you no longer own or can no longer use.
3. Rules that apply
ⓘ ACH payments follow industry rules and US law, and you agree to them.
ACH debits are governed by the NACHA Operating Rules and by US law, including the Electronic Fund Transfer Act and Regulation E for consumer accounts. You agree to be bound by the NACHA Operating Rules as they apply to the entries you authorize. Where these terms and those rules or the law differ, the rules and the law apply.
4. Timing and holds
ⓘ Bank payments take a few business days, and we may hold the money until we know it has cleared.
ACH payments are not instant. A debit usually takes a few business days to settle, and your bank can still return it after that.
- Money added to your Cash Plus Account from a linked bank is generally available after a hold of about 2 business days. We may make it available sooner at our discretion, or hold it longer if we see a risk of return.
- For a transfer to India paid from your bank, we may wait until your payment settles before sending the transfer, or send it sooner at our discretion. Sending early is a courtesy: it does not change your obligation to pay.
- We apply limits to bank-funded payments based on your verification level, account history and risk. Single transfers above ₹5,00,000 must be paid from your Cash Plus Account.
- A debit scheduled for a weekend or bank holiday is processed on the next business day.
5. If a debit is returned
ⓘ If your bank sends a payment back, you still owe us the money and we will take steps to recover it.
Your bank can return a debit for several reasons. The most common are:
| Return code | What it means |
|---|
| R01 | Insufficient funds — there wasn’t enough money in the account. |
| R10 | You told your bank the debit was not authorized. |
| R07 | You told your bank you had revoked your authorization. |
| R29 | A business account holder told its bank the debit was not authorized. |
Other returns include a closed account, a frozen account or an invalid account number. Whatever the reason, a returned debit means we did not receive your payment, and you remain responsible for it. If you authorized the payment, you agree not to claim it was unauthorized.
What we may do
If a debit is returned, we may — to the extent the law and the NACHA Operating Rules allow:
- Try the debit again. For a return for insufficient or uncollected funds (R01 or R09), we may re-present the debit up to two more times within 180 days, as NACHA allows. We do not re-present debits returned as unauthorized or revoked.
- Recover the full amount automatically, including any rupees already paid out to your recipient, any money already withdrawn or spent, and any amount credited to your Cash Plus Account, as described in “Automatic recovery of amounts you owe” below.
- Reverse related credits and rewards, such as Transfer Credit, coupons, scratch-card rewards and referral bonuses tied to the payment.
- Set off what you owe against any balance you hold with us or any refund due to you.
- Hold your balance or pending transfers until the amount is repaid.
- Limit, suspend or close your account, lower your limits, or stop you from paying by bank.
- Recover any actual third-party or bank charges caused by the return. Xpat does not currently charge its own returned-payment fee; if we introduce one, we will tell you before it applies.
- Report the return and related account information to fraud-prevention and account-verification services.
- Pursue collection, including through a collection agency or legal action, and recover reasonable collection costs where the law allows.
A negative balance created by a returned debit is a debt you owe us and is due immediately.
6. Automatic recovery of amounts you owe
ⓘ You must pay for every transfer and service we provide; if a payment fails, is returned or is reversed, we recover what you owe automatically, in the order set out here.
Your promise to pay
When we pay out a transfer, make money available to you or provide a service you confirmed, you owe us the amount you agreed to pay. Returning or disputing a debit, revoking this authorization, stopping a payment with your bank, or closing or changing your bank account does not cancel that debt. It remains due, in full, until it is paid.
In this section, the Amount Owed means any amount you owe us because a debit was returned, charged back or reversed; a transfer or payment we paid out was not fully funded; your Cash Plus Account or another Xpat balance went negative; we credited you by mistake; or a bank or network charged us to process a return caused by you.
Your authorization for recovery
By accepting this authorization, you authorize us, our payment partners and their originating bank to recover the Amount Owed automatically and without further demand, using the steps below, except where this section or the law requires us to notify you first. We will never recover more than the Amount Owed.
- Your Xpat balances. We take the Amount Owed from your Cash Plus Account or any other Xpat balance, as permitted by the terms of those accounts, including money that arrives later — such as a direct deposit, an incoming payment, or a refund or reward due to you. We may do this immediately and hold incoming money until the Amount Owed is repaid.
- Trying a returned debit again. If a debit was returned for insufficient or uncollected funds (return codes R01 or R09), we may present it again up to two more times within 180 days of the original settlement date, as the NACHA Operating Rules allow. A retried debit shows on your bank statement as “RETRY PYMT”.
- A recovery debit to your linked bank account. For any Amount Owed that remains, we may debit any US bank account you have linked to Xpat for no more than that amount. We will tell you the amount and date of each recovery debit at least 10 days before we make it. You can pay the Amount Owed another way before that date, and we will then cancel the debit.
- Collection. If the Amount Owed is still unpaid, we may refer it to a collection agency, report it to fraud-prevention and consumer reporting agencies where permitted, and take legal action, and you agree to pay our reasonable costs of collection where the law allows.
Until the Amount Owed is repaid, we may also hold your pending transfers, limit or suspend your account, and stop you from paying by bank.
When we need a new authorization from you
We will not debit a bank account again under this authorization if a debit to that account was returned because you told your bank it was unauthorized or not as authorized (R10, R11 or R29), because you revoked your authorization (R07), or because the account was closed or frozen (R02 or R16). In those cases we will ask you for a new authorization before debiting any bank account. These returns do not cancel the Amount Owed: we will still recover it from your Xpat balances and through collection, and we may require you to repay it or provide a new authorization before you can use Xpat again.
Fraud and false claims
If you, or someone you allowed to use your bank account, authorized a payment and then told your bank it was unauthorized, the claim is false and is fraud. In addition to recovering the Amount Owed, we may immediately freeze your Xpat balances to recover it, close your account, provide your bank with the record of your authorization, and report the matter to fraud-prevention services and, where appropriate, law enforcement.
Your rights
The law lets you revoke this authorization and dispute a debit with your bank, and nothing in this section takes those rights away. Doing so stops the specific debits involved; it does not cancel the Amount Owed, which we will continue to recover as described above.
7. Disputing a debit with your bank
ⓘ Talk to us first, and never tell your bank a payment you made was unauthorized.
If you think a debit is wrong, please contact us first — we can usually fix it faster than your bank can. If we took the wrong amount or debited you by mistake, we correct it.
If you dispute a debit with your bank and the payment was one you authorized — or one made by someone you allowed to use your account — the claim is false. Falsely claiming that a debit was unauthorized is fraud. In that case, in addition to the steps above, we may close your account and report the matter to fraud-prevention services and, where appropriate, law enforcement.
If a debit truly was unauthorized, tell us straight away. Your rights are described in “Your consumer rights” below and in our Refunds, cancellations & errors policy.
8. Cancelling your authorization
ⓘ You can stop future debits by cancelling in the app or telling us in good time before the next one.
You can revoke your authorization for future debits at any time. A revocation doesn’t affect debits already started, or anything you owe us.
- To stop a single scheduled or repeating payment, cancel it in the app.
- To stop all debits, remove the linked bank account in the app.
- Or contact support by chat, at support@xpat.money or on +1 866-421-4888. We must receive your request while the payment still shows as Scheduled — before we begin processing it — so that we have a reasonable opportunity to act on it.
You may also be able to ask your bank to stop a payment. If you do, please tell us too, so that we don’t try the debit again. Stopping a payment with your bank doesn’t cancel what you owe for a transfer we have already sent.
9. Keeping a copy
ⓘ Keep a copy of this page and your receipts for your records.
We send you a confirmation or receipt for each payment you authorize, and this authorization is always available at xpat.money/ach-authorization. Please save or print a copy for your records. Under our Electronic communications consent, we provide these records electronically. We keep a record of your authorization for as long as the NACHA Operating Rules and the law require.
10. Your consumer rights
ⓘ If you use a personal bank account, federal law gives you protections, and nothing here takes them away.
If your linked account is a personal (consumer) account, the Electronic Fund Transfer Act and Regulation E give you rights, including the right to stop preauthorized payments, to be told about changes in the amount of repeating payments, and to have errors and unauthorized transfers investigated. Your bank also has its own obligations to you for debits to your bank account.
If you think a debit was unauthorized or wrong, contact us at once by in-app chat or +1 866-421-4888. Nothing in this authorization limits rights you have under the law.
